These terms apply to all visitors, customers, and business clients (B2B and B2C) who use our platform. If you do not agree with any part of these terms, you must not use our website or services.

2. Orders and purchases

By placing an order on our platform, you confirm that:

  • You are at least 18 years of age, or acting with the consent of a parent or guardian
  • All information you provide during checkout is accurate and complete
  • You are authorised to use the payment method provided

All orders are subject to availability and confirmation. We reserve the right to cancel or refuse any order at our discretion — for example, in cases of pricing errors, suspected fraud, or stock unavailability. You will be notified promptly if this occurs.

An order is only confirmed once you receive an official order confirmation email from Swam Technologies.

3. Pricing and payment

All prices displayed on our website are in Kenyan Shillings (KES) and include applicable taxes unless stated otherwise. Prices are subject to change without notice, but changes will not affect orders already confirmed.

We accept the following payment methods:

  • M-Pesa
  • Credit and debit cards
  • Bank transfer

Payment must be made in full at the time of purchase unless a separate credit arrangement has been agreed in writing (B2B clients only). We do not store your full card details — see our Privacy Policy for details.

4. Delivery

We will make every effort to deliver your order within the timeframe indicated at checkout. Delivery times are estimates only and are not guaranteed. Swam Technologies is not liable for delays caused by third-party couriers, weather, or other circumstances beyond our control.

Risk of loss and title for goods passes to you upon delivery to the address provided during checkout. It is your responsibility to ensure the delivery address is correct. We are not liable for items delivered to an incorrect address provided by the customer.

5. Returns and refunds policy

Please read this section carefully before placing your order.

No returns after 24 hours

All goods sold by Swam Technologies are eligible for return or exchange only within 24 hours of delivery. After this period, all sales are considered final and no returns will be accepted under any circumstances.

To be eligible for a return within the 24-hour window, the item must be:

  • Unused and in its original condition
  • In its original packaging, with all tags, accessories, and documentation intact
  • Accompanied by proof of purchase (order confirmation or receipt)

Items that do not meet these conditions will not be accepted for return, even within the 24-hour period.

No refunds

Swam Technologies does not offer monetary refunds. All sales are final once an order has been confirmed and payment processed. In the event that a return is accepted within the 24-hour window and the item qualifies, we may offer a store credit or exchange at our sole discretion — not a cash or card refund.

Exceptions

The only exceptions to the above policy are:

  • Items delivered in a damaged condition — if your item arrives visibly damaged, you must notify us within 24 hours of delivery with photographic evidence. We will assess the claim and, if validated, offer a replacement or store credit.
  • Wrong item delivered — if you receive an item different from what you ordered, contact us within 24 hours of delivery and we will arrange a correction at no additional cost to you.

Claims made after the 24-hour window will not be entertained, regardless of the reason.

How to initiate a return or claim

To initiate a return or damaged/wrong-item claim within the eligible period:

  • Email us at info@swamtechnologies.co.ke within 24 hours of delivery
  • Include your order number, a description of the issue, and photographs where applicable
  • Do not return items without first receiving written approval from our team

Unapproved returns will not be accepted and items will not be held or returned to sender.

6. Intellectual property

All content on our website — including product images, descriptions, logos, graphics, and text — is the property of Swam Technologies or our content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from our site without our prior written consent.

7. User accounts

If you create an account on our platform, you are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorised use of your account. Swam Technologies is not liable for any loss or damage arising from your failure to keep your account secure.

We reserve the right to suspend or terminate accounts that violate these terms or are used for fraudulent activity.

8. Limitation of liability

To the fullest extent permitted by Kenyan law, Swam Technologies shall not be liable for:

  • Indirect, incidental, or consequential losses arising from your use of our website or products
  • Loss of profit, revenue, data, or business opportunity
  • Delays or failures caused by events outside our reasonable control (force majeure)

Our total liability to you for any claim arising from a purchase shall not exceed the amount you paid for the relevant order.

9. Governing law

These Terms and Conditions are governed by and construed in accordance with the laws of Kenya. Any disputes arising from these terms or your use of our platform shall be subject to the exclusive jurisdiction of the courts of Kenya.

We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website.
